Why You Should Include a Financial Summary Table in Your Hardship Waiver Index
I’ve ghost-written 👻 countless successful I-601/I-601A etc. hardship waiver briefs and indexes on behalf of client attorneys.
Having a refugee background, myself, I can’t describe how rewarding it feels to help someone obtain legal status and stay united with their family.❤️
➡ I always do my utmost to make the index and brief as strong and as compelling as possible be for this reason.
➡ I always try to improve on presenting the extreme hardship the U.S. citizen or LPR beneficiary would suffer if separated from his/her undocumented family member.
That means, among other things, making the index as brief and concise and direct as possible.
💡I’ve found that showing financial hardship, which revolves around a lot of numbers, is made easier if you include a financial summary table in the index (some attorneys do this, and do it well, but far from all I’ve found).
❓ So how do you do it? The basics are simple (which sometimes need to be modified).
Based on the documentation received (pay slips, mortgage statements, credit card bills, utility bills, etc.) you create a document with:
📊 A table showing average monthly income of applicant and beneficiary.
📊 A table showing average monthly expenses of the household.
📊 A table showing credit card debts and loans.
📊 A table which shows the difference between expenses and income.
✴ The benefit: A financial summary like this in the index speaks for itself, and all you need to do is refer to it when further making the case for why the applicant would suffer extreme financial hardship.
It saves you and the adjudicator time and mental energy!
Ultimately, it’s about winning your client’s case. To me, that means helping a fellow human being in need, pure and simple.
